Why the criterion changed this week

Last week we ranked this category by adoption speed for a small tech team. That criterion produced a useful list for someone standing the stack up. It is not the right criterion for the conversation a head of talent now has with their general counsel.

Four bias-audit regimes are in force or about to bite. NYC Local Law 144 has been live since July 2023. Illinois HB 3773 took effect January 1, 2026. Colorado AI Act applies to high-risk AI starting February 1, 2026. The EU AI Act puts hiring AI in Annex III and the high-risk obligations are ramping through this year. Every one of them asks the same question in different words: can the buyer produce, on demand, the inputs, the model surface, the human override path, and the per-decision record. That is the lens this week.

The criterion, written down

Three rules. A platform earns its rank by how concretely it answers each one in publicly inspectable form.

Rule 1. Show the inputs and the surface

What features of the candidate did the model see, and what features did it weigh? A platform that ships an AI Principles Framework, a published model card, or per-claim sourcing is producing this artifact. A sealed score behind 'AI matching' is not.

Rule 2. Show the human override path

An auditor will ask whether a human could intervene at the level of a single decision, not at the level of a process. A one-tap approval queue with a logged override beats a generic 'recruiter can review' bullet.

Rule 3. Show the per-decision record

Every accepted, rejected, or revised score must leave a trace the buyer can pull. The bias-audit reports under NYC Local Law 144 and the high-risk record-keeping under the EU AI Act both reduce to this sentence.

Which laws are you actually ranking against?

Four. NYC Local Law 144, in effect since July 2023, requires bias audits and candidate notice for automated employment decision tools. Illinois HB 3773, effective January 1, 2026, requires similar disclosures and prohibits AI use that creates discriminatory effect in hiring. Colorado AI Act (CAIA) takes effect February 1, 2026 with high-risk AI obligations that include employment decisions. Why is Workday and Paradox not in the ranked list?

Workday completed the Paradox acquisition on October 1, 2025. Paradox is now positioned inside Workday for high-volume frontline hiring (think 7-Eleven, Marriott, Chipotle, Wendy's, FedEx). It is no longer a buyable standalone for a 40 to 250 person tech team running engineering and go-to-market reqs. We mention it here so a buyer who saw it on lists last year understands why it is not a candidate this quarter.

Is a list with seven entries enough?
